FAIR USE AUTHORIZATION FOR ROURKE BABY RECORD
- Use of the RBR GUIDES/NOTES and associated Resources: The Rourke Baby Record (RBR) has been made freely available since its original development to facilitate widespread access to high-quality information for the care of infants and children. The RBR is affiliated with the Canadian Paediatric Society (CPS) and the College of Family Physicians of Canada (CFPC), and is endorsed by the CFPC, CPS, and Dietitians of Canada. Healthcare providers, organizations and governments are encouraged to incorporate and support the use of the RBR to facilitate the primary care of infants and children.
- The RBR can be downloaded free of charge from this website subject to all terms listed herein. Users expressly assume all medical, legal, and financial risks associated both with their use of the RBR and as a condition of use of the RBR and agree to indemnify and hold harmless the RBR Authors from any and all claims, liabilities, costs, or damages arising from such use, including but not limited to the development or distribution of any modifications.
- Excerpts from this website may be copied or reproduced for print without permission only for purposes permitted under the fair dealing exceptions in the Canadian Copyright Act, including education, research, private study, criticism, review, and news reporting. When applicable, full acknowledgment must be given to the Authors, including the full name of the Authors, the title and URL of the web page, and the date on which the information was captured.
- The RBR is provided for physicians and other healthcare providers for specific educational needs, as a tool, and to supplement their medical training and experience. The RBR represents an assessment of the literature, which is offered as information that physicians and other healthcare providers may consider in their professional judgement in the care of infants and young children and their families. Different methodologies may result in different assessments and recommendations. Given the constantly evolving nature of the evidence and changing recommendations, the RBR Evidence-Based Infant/Child Health Maintenance Guide and any other information provided herein is meant to be a guide only and does not constitute ‘medical advice’. The Authors of the RBR have made every effort to provide accurate and current information, but do not guarantee the accuracy, completeness or timeliness of the information provided. The information contained in the RBR is subject to change without notice.
- Provisos on modifications to the web/paper Rourke Baby Record GUIDES/NOTES and associated Resources: Certain population groups or regions may want to modify the RBR content to more accurately reflect local or culturally relevant content. Permission for modification is subject to the following conditions:
- The Authors will not be asked to provide expertise towards the development of a modified version, or to review a modified RBR.
- The Authors do not endorse any modified versions of the RBR. Any such modifications are undertaken solely at the risk of the modifying party, who assumes all associated liability.
- The Authors have no responsibility for the edits or changes made to a modified version and are not responsible for providing any updates.
- The endorsements of the CPS, CFPC and the Dietitians of Canada do not apply to modified RBR versions.
- The most recent edition of the RBR is to be used as the basis for the modification (currently 2024 edition).
- Modifications must not contradict the evidence-based intent, methodology, or purpose of the RBR. The RBR may not be used or adapted by any individual or group to promote an ideological, political, commercial, or non-evidence-based agenda. Any such use is strictly prohibited and constitutes unauthorized use under the Copyright Act.
- The modified record is clearly identified on each form as a modification from the 2024 RBR by the group involved. (eg RBR 2024-“XYZ” modification). The searchable web-based title of the modified version of the RBR needs to include similar modifier identification.
- Copyright and intellectual property of the Rourke Baby Record content, including but not limited to previous editions of the Rourke Baby Record, remains with the RBR authors.
- There is no fee charged to users for the utilization of the RBR modification. (The web/paper RBR has always been free of charge in the public domain.)
- Commercial distribution of any modified RBR content is strictly prohibited without the express written consent of Drs. Rourke and Dr. Leduc. This includes distribution through digital platforms or applications, whether offered for a fee or free of charge, if supported, developed, or affiliated with commercial entities. Unauthorized commercial use constitutes an infringement under the Copyright Act and may result in legal action.
- The contributor/modifier assumes all legal risks and costs associated with using the modified RBR and holds the RBR authors harmless.
- Provisos on inclusion of the Rourke Baby Record GUIDES/NOTES and associated Resources in Electronic Medical Records (EMRs): The Authors recognize the importance and near-universal utilization of EMRs in facilitating the provision of excellent clinical care. Permission to include the RBR in an EMR requires the EMR firm to sign a license agreement. The EMR firm assumes full responsibility for uploading and maintaining the most current RBR version and for ensuring compliance with any applicable certification standards such as those required by OntarioMD or the provincial/territorial EMR System certification standards that are applicable to the Province/Territory of the User. - Financial contributions to support ongoing RBR development projects and initiatives are welcome. All contributions will be acknowledged. This is not a charitable donation.
